The concept of phone recording is one which has been heavily publicised at times. There are harsh legal barriers against anyone that tries to record a telephone conversation without a warrant, as this is thought of as a violation of privacy. For the govt. to record a phone conversation, they have to get a warrant. To get such a warrant, they have to show a judge that there's reasonable suspicion that a crime is being committed, and the people who would be recorded are somehow concerned in that crime. Without this, most judges won't issue a warrant for a phone “tap.”

A phone recording device is sometimes called a “covert listening device.” These often have the nickname of “bugs,” since they are regularly small radio transmitters attached to the phone with a small mic. During the past, this is how police investigators used to listen in on the telephone chats of suspects. This is a complicated subject, since any recording or eavesdropping of a telephone conversation without a warrant is against privacy laws. Proof acquired from the bugging or wiretapping of phone lines isn't admissible in court without a warrant from a judge.
